1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the myalbie.ai website, mobile, and messaging experiences (collectively, the "Services"). By creating an account, purchasing a subscription, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

2. Eligibility & Account Security

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. Users between 13 and 18 must have permission from a parent or legal guardian. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at communications@myalbie.com if you suspect unauthorized access.

We reserve the right to refuse service, reclaim usernames, and require identity or payment verification as needed to protect the Services and community.

3. Subscriptions & Billing

Certain features require a paid plan. When you purchase a subscription, you authorize us and our payment processors (such as Stripe) to charge your chosen payment method the fees disclosed at checkout, including recurring charges until you cancel. All fees are denominated in U.S. dollars unless otherwise stated and are non-refundable except where required by law.

You may cancel recurring plans at any time through your account settings or the applicable app store. Cancellations take effect at the end of the current billing period, and you remain responsible for any outstanding charges.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party right
• Upload or transmit malicious code, spam, or unauthorized advertising
• Engage in harassment, hate speech, or activity that exploits or harms minors
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Services or related systems
• Use Albie outputs to develop competing models or datasets without written consent

We may investigate violations and suspend or terminate accounts to protect the platform and our users.

5. User Content & License

You retain ownership of the content you submit ("User Content"). By uploading or sharing User Content, you grant Albie a worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, and display that content as necessary to operate, improve, and provide the Services to you and other users.

You represent that you have all rights necessary to grant this license and that your User Content does not infringe or misappropriate the rights of any third party.

6. AI Outputs & Educational Use

The Services generate AI-created text, plans, reminders, and other materials ("AI Outputs"). You may use AI Outputs for personal, non-commercial educational purposes, subject to these Terms. AI Outputs may be inaccurate, incomplete, offensive, or inconsistent with current standards. You are solely responsible for reviewing and verifying all AI Outputs before relying on them.

You agree not to present AI Outputs as professional advice nor use them in high-risk scenarios without human review.

7. Privacy & Data

Our collection and use of personal information is described in the myalbie.ai Privacy Policy. By using the Services, you consent to the processing of your information in accordance with that policy and applicable law. We may monitor interactions with the Services to enforce these Terms, maintain safety, and improve features.

8. Intellectual Property

The Services, including the Albie name, logos, designs, software, and proprietary prompts, are owned by Albie and protected by copyright, trademark, and other laws. Except for the limited rights expressly granted in these Terms, no license is granted to you, and all rights are reserved by Albie.

9. Third-Party Services

The Services may link to or integrate with third-party platforms. Your use of those services is governed by the third party's terms and privacy policies. Albie is not responsible for third-party content, products, or services.

10. Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive activity, or created a risk of harm to Albie, our community, or third parties. Upon termination, your right to use the Services will immediately cease, but Sections 5 through 15 will continue in effect.

11. Disclaimers

THE SERVICES AND AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE, AVAILABLE AT ALL TIMES, OR THAT AI OUTPUTS WILL MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALBIE AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR AI OUTPUTS. OUR TOTAL LIABILITY FOR ANY CLAIM UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO ALBIE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Albie and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws and regulations of the Dubai Silicon Oasis Authority and the applicable laws of the United Arab Emirates, without reference to conflict-of-law principles. Any dispute arising out of or relating to the Services will be subject to the exclusive jurisdiction of the courts located in Dubai, United Arab Emirates. Where required by law, you may have additional rights or remedies in your home jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice via email, in-app messaging, or a prominent notice on myalbie.ai and update the "Effective Date" above. Continued use of the Services after the revised Terms become effective constitutes acceptance of the changes.
